If you are an individual residing in the United States whose Private Information was compromised by the targeted cyberattack on Jack’s Family Restaurants, LP's (“Jack’s”) computer systems that occurred approximately between July 24 – August 10, 2025 (the “Data Incident”), including all persons who were sent notice of the Data Incident, you may be a Settlement Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (a) directors, officers, and employees of Defendant; (b) the Judge assigned to the Action, that Judge’s immediate family, and Court staff; and (c) any Settlement Class Member who properly opts out of the Settlement.

If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a claim form by November 30, 2026.

Settlement Class Members may claim Credit Monitoring Services and either (I) reimbursement for Documented Losses and/or (II) reimbursement for Lost Time or (III) an Alternative Cash Payment as described below.

Credit Monitoring Services. All Settlement Class Members are eligible to receive three (3) years of Identity Theft Protection and Credit Monitoring. This may include:

  • real time monitoring of the Settlement Class Member's credit file at a credit bureau

  • dark web scanning with immediate notification of potential misuse

  • comprehensive public records monitoring

  • identity restoration and recovery services

  • $1,000,000.00 identity theft insurance with no deductible

Cash Payment A - Documented Losses. Class Members who incurred actual, documented out-of-pocket losses due to the Data Incident, can get back up to $4,000.00. This benefit covers out-of-pocket expenses like:

  • unreimbursed charges from banks or credit card companies

  • unreimbursed costs to replace your driver’s license, Social Security number, or other types of identification

  • unreimbursed costs for credit reports

  • unreimbursed costs for credit monitoring and identity theft protection first purchased by Settlement Class Members between July 24, 2025, and the Claims Deadline. (To receive reimbursement, you must provide (i) proof of purchase, and (ii) an affirmative written statement that it was purchased primarily because of the Data Incident and not for other purposes.)

Third Party Documentation Required: You must submit Third-Party Documentation, such as receipts, to verify the costs you incurred. You may submit “self-prepared” documents to clarify or support other submitted documentation, but self-prepared documents by themselves are not sufficient to file a valid claim.

Cash Payment B - Reimbursement for Lost Time. In lieu of or in addition to submitting a claim for Cash Payment A - Documented Losses, Class Members may request a reimbursement cash payment of $20.00 per hour for up to four (4) hours of time spent responding to the Data Incident for a maximum of $80.00.

Cash Payment C - Alternative Cash Payment. In lieu of Cash Payment A – Documented losses and Cash Payment B – Reimbursement for Lost Time, you may request a cash payment of $55.00.

The deadline to submit a Claim Form online or by email is November 30, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than November 30, 2026.
